Photographic Rights
1. The entire copyright of the Photographs is retained by Andrew at all times throughout the world

and shall under no circumstances be assigned to You.

 

2. Andrew may like to use the Photographs to promote his own business.

 

3. Andrew may use any or all of the Photographs for any purposes throughout the world for the full period of copyright. Andrew shall have permission to use any and/or all photographs for any purpose including (without limitation) display, exhibition, competition, social media, internet, television and/or and printed media publications for the promotion of Andrew’s business.

 

4. You shall be entitled to make copies of any photographs provided by Andrew for your personal use or distribution to friends and family members. You shall also be entitled to post images on social media. However, you agree that you shall not, except for cropping, edit any photographs provided by Andrew. You also agree that you shall not use (and shall not permit any other to use) any photograph for any commercial purpose or in any publication (including, without

limitation, publication on any public website) without the prior written consent of Andrew. Andrew offers commercial photograph packages, if you intend to use images for business then you can book one of these.

 

5. By signing this Agreement You both irrevocably and unconditionally waive your respective rights under the Copyright, Designs and Patents Act 1988 Section 85, as amended from time to time, and under the laws now or in the future applying outside the United Kingdom concerning the Photographs.

 

6. You confirm that the waiver contained in this agreement is for the benefit of Andrew.

 

Liability
 

7. Andrew shall be granted full creative and artistic licence concerning the Photographs including without limitation, their selection, editing and post-processing. Andrew’s judgement on photographic style shall be deemed correct. Andrew will endeavour to take and provide photographs that are specifically requested by You before the session. However, due to the availability and willingness of subjects, Andrew does not undertake to guarantee that specific photographs will be taken, nor that any specific background or group arrangement will be incorporated. Also, as the willingness of subjects is outside the control of Andrew, no guarantee is given that everyone present will be included in photographs taken by Andrew.

 

8. If Andrew is unable to photograph your family due to any circumstances beyond Andrew’s reasonable control, including (without limitation) natural disasters, civil unrest, force majeure, injury or sickness, all reasonable efforts will be made by Andrew to find a replacement photographer, although this cannot be guaranteed. If another photographer cannot be found, all monies paid by You will be refunded in full. Andrew shall have no further liability to You for any additional losses, costs or expenses incurred as a result of any inability to attend.

 

Confidentiality
9. Andrew shall keep confidential and will not disclose to any third parties or make use of material or information communicated to him in confidence for the purposes of the Photography Services, save as may be reasonably necessary to enable Andrew to carry out his obligations concerning the Photography Services, the Photographs and creation and delivery of products.

 

Law

10. This agreement shall be governed by the laws of the United Kingdom.
